Freedom of information

The Freedom of Information (Scotland) Act 2002 (FOISA) provides you with a right of access to information we hold. If you are looking for information that is not available under our publication scheme then you can request it from us.

The Environmental Information (Scotland) Regulations 2004 (EIRs) separately provides a right to access environmental information we hold.

When writing to request information, please include your name, address, full details of the information you would like to receive and a telephone number in case it is necessary to contact you.

What happens next?

We will check to make sure we have enough information from you in order to comply with your request. We will send out an acknowledgement confirming receipt of your request within 3 working days and if we don’t have enough information from you to respond to your request we will also contact you to clarify your request.

Our aim is to provide information whenever possible. In all cases, you should receive a response from us promptly and no later than 20 working days from receipt of your request.

Cost

SAAS do not charge for answering information requests and for providing information electronically, but we may refuse to provide information if the cost of doing so would exceed £600.

We may charge for providing information to you e.g. photocopying and postage, but we will charge no more than it actually costs us to do so. We will always tell you what the cost is before providing the information to you. You can find more information on costs in our Guide to Information.

Publication

All responses to Freedom of Information Requests are published in an anonymised format.

Right to Review and Appeal

If you are unhappy with the response to your FOI request, you may ask us to carry out an internal review of the response, by writing to:

Your review request should explain why you are dissatisfied with this response, and should be made within 40 working days from the date when you received this letter. We will complete the review and tell you the result, within 20 working days from the date when we receive your review request.

If you are not satisfied with the result of the review, you then have the right to appeal to the Scottish Information Commissioner. You should keep copies of all correspondence you have had with us, as if you decide to appeal to the Scottish Information Commissioner you will be asked to provide these.

Request for Personal Information

The Data Protection Act, 1998 gives you the right to know what information is held about you.

Request for personal information must be made in writing and are known as a ‘subject access request’ (SAR). A SAR can be made by completing and sending to us a subject access request form.
